Petition Form for the Trade Adjustment Assistance (TAA) Program Including a Spanish Version |
Purpose. To provide a copy of ETA Form 9042A and 9042A-1, Petition for Trade Adjustment Assistance and Solicitud de Asistencia Para Ajuste.
References. The Trade Act of 1974, as amended (P.L. 93-618, as amended); the Trade Act of 2002 (P.L. 107-210); and the Paperwork Reduction Act of 1980, as amended.
Background. On August 6, 2002, President George W. Bush signed into law H.R. 3009, the Trade Act of 2002 (2002 Act). The 2002 Act makes several amendments to the Trade Act of 1974. The 2002 Act also repeals subchapter D of chapter 2 of title II of the Trade Act of 1974, as amended (the NAFTA-TAA program). The amendments apply to petitions for adjustment assistance that are filed on or after November 4, 2002.
In response to the 2002 Act, ETA has developed a new Petition for Trade Adjustment Assistance, ETA Form 9042A, and its Spanish translation, ETA Form 9042A-1. ETA Forms 9042A and 9042A-1 will replace and eliminate the current Petition for Trade Adjustment Assistance, ETA Form 8560 (1205-0192, expiring 7/03); the Petition for NAFTA Transitional Adjustment Assistance, ETA Form 9042 (1205-0342, expiring 8/04); and their translations.
ETA Forms 9042A and 9042A-1 are approved by the Office of Management and Budget (OMB) in accordance with the Paperwork Reduction Act of 1980, as amended, OMB approval number 1205-0342, expiration date March 31, 2003.
Action Required. State administrators are requested to distribute the approved form to appropriate state staff. States are requested to make ETA Forms 9042A and 9042A-1 available in all local offices to persons wishing to file a petition for Trade Adjustment Assistance beginning November 4, 2002. ETA Forms 9042A and 9042A-1 should not be available to petitioners prior to November 4, 2002.
State administrators are also requested to ensure that copies of the current petition forms, ETA Form 8560, Form 9042, and their translations, are not available to petitioners after November 3, 2002. The current petition forms should be removed from local offices and from State websites.
