Revised Definition of “Inactive Employer” for Form ETA 581, Contribution Operations |
Purpose. To clarify the definition of “inactive employer” in regard to “no wage” reports and missing reports.
Background. Part c. of “E. 3. Inactive Employer” in the instructions for Form ETA 581, may be interpreted in a way that is inconsistent with the intent of the instructions, i.e., an employer becomes inactive only if the employer has filed eight consecutive quarterly reports showing no wages paid. The intent is that if there are eight consecutive quarters with no evidence of wages having been paid, regardless of whether or not eight quarterly “no wage” reports were filed, the definition of “inactive employer” is met.
Revision. Part c. of the definition for “inactive employer” is being changed to read, “for eight consecutive calendar quarters has filed quarterly reports showing no wages paid, or has not filed quarterly reports and has or has not been assessed for such reports, or any combination of these occurrences. The effective date is the last day of the eighth quarter for which these events occur."
OMB Approval. These reporting instructions are approved by the Office of Management and Budget (OMB) according to the Paperwork Reduction Act of 1995, OMB Approval No. 1205-0178, expiration date: August 31, 2005.
