One Year Requirement to Retain Basic Information in the State Public Employment Service Agencies |
Purpose. To advise State Employment Security Agencies that the Office of Management and Budget (OMB) has extended approval of the recordkeeping requirement to retain work application and job order information under 20 CFR 652.8 (d) (5).
References. 20 CFR 652 and the Wagner-Peyser Act, as amended.
Background. States collect basic labor exchange information, using a system of their choice. The exact information to be collected is:
determined by the State;
information that is essential to the operation of a labor exchange job placement service; and
normally collected as part of Job Matching. At a minimum, this information enables the State to comply with regulations under 20 CFR Part 652, and the Wagner Peyser Act, as amended.
Retention Requirement. The requirement to retain information under 20 CFR 652.8(d)(5) is:
"Each State shall retain basic documents for the minimum period specified below:
(i). Work application: one year
(ii). Job order: one year."
The document (hard-copy, computer record, etc.) in which the information is maintained is not specified in the regulation.
OMB Approval. Approval of the recordkeeping requirements has been extended by the office of Management and Budget according to the Paperwork Reduction Act of 1995 under OMB approval No. 1205-0001, to expire 12/31/2000.
Persons are not required to maintain these records unless it displays a currently valid OMB control number. Respondents' obligation to maintain these records are mandatory per 20 CFR 652 .8 (d) (5) .
Burden Disclosure. It is estimated that it will take an average of 8 hours annually for maintaining work application and job order data. If there are any comments regarding these estimates or any other aspect of this recordkeeping requirement, including suggestions for reducing this burden, send them to the Department of Labor, U.S. Employment Service, 200 Constitution Avenue, N.W., Room N-4470, Washington, D.C. 20210 (Paperwork Reduction Project 1205-0001).
